The Holiday Block Terms of Service
1. Introduction and Acceptance of Terms
Welcome to The Holiday Block.
The Holiday Block is a mobile application operated by High Tide Digital to help families discover and create holiday experiences in their neighborhoods—finding decorated houses, planning a route for the evening, adding a home to the map, and sharing updates that help other families along the way.
These Terms of Service ("Terms") govern your access to and use of The Holiday Block. In these Terms, "Service" means The Holiday Block mobile application for iOS and Android and any related services we provide in connection with the app.
These Terms are product-specific Terms for The Holiday Block. They should be read together with the High Tide Digital Terms of Service, which explain our broader company practices.
By accessing or using The Holiday Block, you agree to these Terms. If you do not agree, please do not use the Service.
2. Using the Service
You're welcome to use The Holiday Block to explore holiday decorations and neighborhood participation, add or update your home on the map, plan a visit route, and share community updates that help other families.
When using the Service, you agree to:
- Use it in a lawful manner.
- Respect the rights of others.
- Provide accurate information when you add or update your home or submit community updates about nearby houses.
- Not submit false, misleading, or spam updates about house participation, treat availability, lights, crowd levels, or similar seasonal details.
- Not claim a home on the map that is not yours.
- Not attempt to interfere with the operation or security of the Service.
- Not use the Service to distribute malicious software or harmful content.
- Not attempt to gain unauthorized access to our systems, accounts, or information.
We reserve the right to restrict or terminate access to the Service for users who violate these Terms or misuse the Service.
3. Prohibited Conduct
The Holiday Block depends on accurate, good-faith community participation. To protect families using the map and the integrity of neighborhood information, you may not use the Service in the following ways:
- Use the Service for commercial solicitation, advertising, or promotion without our prior written permission.
- Submit house participation information or community updates about a location without a good-faith basis to do so.
- Submit optional notes or other information that is unlawful, threatening, harassing, defamatory, obscene, or otherwise inappropriate for a family-facing community app.
- Misrepresent your relationship to a home, address, or neighborhood when adding or updating information on the map.
- Use automated tools or scripts to scrape, copy, or bulk collect information from the Service.
- Attempt to circumvent technical limits, access controls, or other restrictions in the Service.
- Create or use multiple accounts to evade limits or restrictions that apply to your use of the Service.
- Deliberately undermine the accuracy or reliability of map information through repeated, coordinated, or bad-faith submissions.
You are responsible for the information you submit through the Service. Violations of this section are also violations of these Terms and may result in restriction or termination of your access to the Service.
4. Intellectual Property
Unless otherwise noted, The Holiday Block application and the content we make available through the Service—including the software, designs, text, graphics, logos, branding, and other original materials—is owned by or licensed to High Tide Digital and is protected by applicable intellectual property laws.
You may use the Service and our content for your personal, non-commercial use in connection with the app, provided you do not modify or remove any copyright, trademark, or other proprietary notices.
You may not copy, reproduce, distribute, publish, sell, or create derivative works from our app, software, or content without our prior written permission, except where permitted by applicable law.
Map display and location-related features in the Service may rely on map data or services provided by third parties such as Apple or Google. Those materials are provided by their respective owners and are subject to their own terms and policies.
All trademarks, service marks, logos, and brand names displayed in or through the Service—including The Holiday Block branding—are the property of High Tide Digital or their respective owners.
When you submit house participation information, community updates, or optional notes through the Service, you retain any rights you have in that information. You give High Tide Digital permission to use, store, display, and process your submissions as needed to operate and provide the Service, including making submitted information visible to other users as part of the community map experience. You represent that you have the right to submit that information and that your submissions do not infringe the rights of others.
5. Third-Party Services and Links
The Holiday Block relies on third-party services to help us operate the app. For example, we use Firebase and Google Cloud for authentication, data storage, and backend processing; Apple or Google map services for map display and location-related features; and Apple Push Notification Service or Google notification services when you enable push notifications.
When you choose to start navigation to a route stop, the app may open Apple Maps, Google Maps, or another navigation app on your device. Downloading, installing, or updating The Holiday Block through the Apple App Store or Google Play Store may also involve those platforms' services.
High Tide Digital does not own or control these third-party services and is not responsible for their content, availability, privacy practices, or policies. Your use of any third-party service is governed by that provider's own terms and privacy policies.
We encourage you to review the terms and privacy policies of any third-party services you choose to use, especially when you leave The Holiday Block to use navigation or app store services.
6. Disclaimer of Warranties
The Holiday Block and the Service are provided on an "as is" and "as available" basis.
While we work to provide a helpful community map experience, house participation information and community updates come from homeowners and other users and may not always be complete, accurate, or current. We do not guarantee that every house shown on the map is open, actively participating, or accurately reported at any given time, or that the Service will always be uninterrupted, error-free, secure, or free from viruses or other harmful components. Temporary outages, mapping inaccuracies, and the availability of location features, push notifications, external navigation handoffs, or other third-party services may also affect how the Service works.
To the fullest extent permitted by applicable law, High Tide Digital disclaims all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Your use of the Service is at your own risk.
7. Limitation of Liability
To the fullest extent permitted by applicable law, High Tide Digital and its owners, employees, affiliates, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of, or inability to use, the Service. Because The Holiday Block is a community-driven neighborhood map, this limitation applies to issues related to user-submitted information, map and slocation accuracy, external navigation handoffs, push notifications, third-party services, temporary outages, and community participation shown on the map.
This includes, but is not limited to, damages for lost profits, lost data, business interruption, or other intangible losses, even if High Tide Digital has been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
8. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to The Holiday Block, our practices, or applicable laws. When we do, we will update the Last Updated date at the beginning of these Terms.
When we make material changes, we will provide additional notice in an appropriate manner when required by applicable law. Your continued use of the Service after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Service.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
Any legal action arising from these Terms or your use of the Service shall be brought in a court of competent jurisdiction located in the State of Texas, unless otherwise required by applicable law.
